With branches across Accra and beyond, Papaye has built a strong reputation for its signature grilled chicken, fried rice, and generous portions.What makes Papaye stand out is its authentic Ghanaian identity, consistent food quality, and deep customer loyalty. Unlike foreign franchises, it offers a uniquely local taste experience while maintaining high standards of hygiene, service, and value for money, making it a beloved name in Ghana’s dining scene.

3. Grant of License and Access Rights

Curia Foods grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform solely for the intended purposes: - Customers: for browsing, ordering, and managing food deliveries. - Restaurants: for managing menus, orders, and receiving payments. - Riders: for managing delivery routes and job schedules.

This license does not permit: - Copying, modifying, distributing, sublicensing, reverse engineering, decompiling, or exploiting any portion of the Platform; - Reselling or redistributing access to the Platform or its services; - Circumventing access restrictions or violating any usage limitations imposed by the Platform.

Violation of this license may result in immediate suspension or termination of your access rights without prior notice.

4. User Account Creation and Security Obligations

To use most features of the Platform, you are required to create an account. You agree to: - Provide truthful, accurate, and up-to-date personal or business information during registration; - Maintain the confidentiality of your login credentials (username and password); - Promptly notify Curia Foods of any unauthorized access or suspected breach of security.

You are solely responsible for all activities under your account. Curia Foods shall not be liable for losses resulting from unauthorized use of your account.

5. Orders, Transactions, and Payment Processing

5.1 Order Process

Once an order is placed and confirmed through the Platform, it is considered binding. The customer agrees to pay the full amount indicated, including: - Food and beverage costs - Delivery charges - Applicable taxes and service fees

5.2 Split Payment System

Curia Foods facilitates automated split payment distribution, where a single customer transaction is divided among: - The restaurant (for the food component) - The rider (for the delivery service) - Curia Foods (as platform service fee)

Payment processing is handled by third-party payment processors. Curia Foods does not store card details directly and is not responsible for payment failures beyond its control.

5.3 Refund and Cancellation

Refunds will be considered only when: - A confirmed order is canceled by the restaurant or delivery partner - The food delivered is severely damaged, missing, or inedible (subject to photographic evidence) - An incorrect or duplicate charge is processed

Refunds will be credited within 5–10 business days depending on the processor. Curia Foods reserves the right to reject refund requests deemed fraudulent or abusive.

6. Third-Party Roles and Responsibilities

6.1 Restaurants

Restaurants are third-party vendors responsible for the preparation and packaging of food. Curia Foods: - Does not cook, package, or alter food products - Is not liable for food safety, allergen exposure, or foodborne illness - Provides a platform for listing and managing restaurant menus

6.2 Riders and Delivery Partners

Riders are independent contractors who use the Curia Foods rider app to accept and deliver orders. Curia Foods: - Does not directly employ riders - Provides route management and tracking tools - Monitors rider performance but is not liable for their conduct beyond the scope of delivery operations

Users are advised to contact customer support immediately in the event of a dispute with a restaurant or rider.

7. Acceptable Use Policy

By using the Platform, you agree not to: - Engage in illegal, fraudulent, or harmful behavior - Impersonate another person or misrepresent your affiliation - Use the platform to transmit viruses or malicious code - Tamper with, overload, or disrupt the servers or infrastructure - Collect or harvest data from other users without consent

Violation of this policy may result in permanent account suspension and legal action.

8. Ownership and Intellectual Property

All content, trademarks, software, and data within the Curia Foods Platform are the exclusive property of Curia Foods or its licensors. This includes but is not limited to: - Platform interface designs - Logos, slogans, and service marks - Backend systems, APIs, and databases

Users may not copy, adapt, or republish any material from the Platform without express written permission.

9. Data Protection and Privacy

Your use of the Platform is governed by the Curia Foods Privacy Policy, which is incorporated into these Terms by reference.

Curia Foods commits to protecting personal data in accordance with the Data Protection Act, 2012 (Act 843). By using the Platform, you acknowledge and consent to the collection, processing, and use of your personal data as outlined in our policy.

10. Termination and Suspension of Access

Curia Foods reserves the right to suspend or permanently terminate access to the Platform in the following cases: - Breach of these Terms - Non-payment or fraudulent activity - Prolonged account inactivity (12 months or more) - Regulatory or legal requirements

Upon termination, you must cease all use of the Platform. We may retain transaction and account data for compliance and audit purposes.

11. Service Availability and Warranty Disclaimer

The Curia Foods Platform is provided “as is” and “as available”. We do not guarantee: - Continuous, uninterrupted access to the Platform - That orders will be accepted or fulfilled on time - That content provided by restaurants or riders will be accurate or up to date

To the maximum extent permitted by law, Curia Foods disclaims all implied warranties, including merchantability, fitness for purpose, and non-infringement.

12. Limitation of Liability

Curia Foods shall not be liable for: - Indirect or consequential damages (e.g., loss of profits, data, goodwill) - Delays or failures caused by third-party vendors or delivery partners - Unauthorized access to your account due to negligence on your part

Our total liability under these Terms shall not exceed the value of your last successfully completed transaction on the Platform.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. In the event of any dispute, you agree to submit to the exclusive jurisdiction of the courts of Ghana.

14. Updates and Revisions

We may update these Terms from time to time. When we do, the updated version will be published on the Platform, and the effective date at the top of the document will be revised.

Continued use of the Platform after such updates constitutes your acceptance of the new Terms.

Welcome to Curia Foods! These End User License Agreement (“EULA”) and Terms of Service (“Terms”) govern your access to and use of our mobile applications, websites, systems, and related digital services (collectively, the “Platform”).

By downloading, accessing, or using any component of the Curia Foods Platform, you agree to be bound by these Terms. These Terms establish a binding legal agreement between you (the “User”) and Curia Foods (“Company”, “we”, “our”, or “us”). If you do not agree with any part of these Terms, you should immediately discontinue use of the Platform.

This agreement applies to all categories of users, including customers, restaurant vendors, delivery riders, support personnel, and third-party service providers, where applicable.

2. Eligibility and Legal Capacity

You must be at least 18 years of age to use this Platform. By registering, installing, or using the Platform, you represent and warrant that you: - Are at least 18 years old; - Have not previously been suspended or removed from the Platform; - Have full legal capacity to enter into binding agreements; - Will comply with these Terms and all applicable laws and regulations.

If you are using the Platform on behalf of an entity (e.g., a restaurant or logistics company), you represent that you are duly authorized to bind that entity to these Terms.
